Dear Sir
I again trouble you with one of our Circulars under the idea that Mrs Tod qualified as Extrx of her first husband, & if so, you & she will, I concieve be the proper parties to the amicable suit proposed to be brought. In this case, it is important I should have from you in answer to the above without loss of time, as I wish the accounts to be closed & a decree obtained this year. I shall at all events avail myself of the present Session of the Court to have filed the bill & answer that an order of reference may be obtained which will save 6 months. I shall also venture to insert your names as well as the names of the children as parties, which can be struck out if you or they decline becoming parties, to the suit. If you can see William & George be so good as to obtain their answers to this letter. I shall write to Walter who is in Jefferson. Inform my friend William that I recd his letter but that it would take me a long time to send him the Statements he requires, which is in fact the very object of the proposed suit, and will employ much of my time this summer in preparing for the Court. All the devisees of Genl W. & their representatives who retain their interests in the estate, & from whom we have recd answers concur cheerfully in the proposed plan. Affectly yrs
