Deed of Sale and Power of Attorney

To all whom it may Concern-
Whereas by deed bearing date the 17h day of April in the year of our Lord 1798 between Henry Lee and Ann his wife of the first part, Bushrod Washington of the second part and William Ludwell Lee of the third part; the said Henry Lee and Ann his wife did convey to me the said Bushrod Washington & my heirs amongst other parcels of land all that tract or parcel of land containing twenty eight hundred acres or thereabouts called and known by the name of Hollis's Marsh in the County of Westmoreland which said tract was purchased by the said Henry Lee from Ludwell Lee, Richard Sandford, & Rigg bounded by the road to Stratford Mill by the road from Stratford to Chantilly, by the Chantilly line and by the Potowmack River including Hollis's Marsh In Trust that in case the said Henry Lee should fail to pay or tender to the said William Ludwell Lee the interest which should become due upon the sum of sixteen thousand, six hundred & sixty six dollars, sixty six cents at the place and times therein mentioned for the payment thereof, that then the credit given to the said Henry Lee for payment of the said principal sum should cease and determine, and upon any such failure that I the said Bushrod Washington my heirs and assigns should without delay upon the request of the said Ludwell Lee his heirs executors administrators or assigns sell and convey at public auction at such times or timew as I at the request of the said William Ludwell Lee his heirs executors admtrs or assigns might appoint after having given four weeks previous notice of the time & place of sale in one of the Richmond or Alexandria papers the whole or such parts of the premises conveyed by the said deed as might be sufficient to satisfy the afsd principal from interest & expenses of sale and the money arising from the said sale after deducting the costs attending the same to pay to the sd William L. Lee his heirs Executors admtrs or assigns in discharge of the afsd principal sum to the interest due thereon & the residue if any to the sd Henry Lee his heirs Exectrs admtrs or assigns as in and by the said deed will more at large appear And whereas I the said Bushrod Washington having been requested by William Hodgson Executor of the said William Ludwell Lee [<2m#>] to sell the land mentioned in the above recited deed for satisfying the principal and interest thereon , (the latter having been in part only satisfied or paid by the said Henry Lee) have appointed the twenty eighth—day of the present month for the sale of the afsd land lying in Westmoreland County, due notice thereof having been published in one of the Alexandria papers— Now Know Ye that I the said Bushrod Washington have ordained constituted and appointed and DO by these presents ordain constitute and appoint John Murphy of the County of Westmoreland my true and lawful attorney for me and in my name and for the uses & purposes in the above recited deed mentioned to sell at public auction to the highest bidder the above mentioned tract of twenty eight hundred acres as above described lying in the said County of Westmoreland, and further to do whatsoever I the said Bushrod Washington could or might lawfully do if I were personally present, hereby ratifying and confirming whatsoever my said Attorney may lawfully do in the premisses.
