Dr Sir,

 

     Your letter of the 17th ult. was not received untill a few days ago on my return home, after an absence of several weeks.

     I am surprised to find that Mr Beverly did not communicate to you what I will now beg leave to mention. After I had read the papers that he submitted to me, an impression was made on my mind that I had seen them before, and it occurred to me that I had probably been retained on behalf of Mr Parks. then Mr Beverly came to have his answer drawn according to previous appointment I stated to him the impression I had received & declined doing any thing further untill I could ascertain whether I was retained or not. On my return home having ascertained that I had been consulted & Spoken to by Mr Fry who had drawn Mr Parks will I wrote to Mr Beverly apprising him that I could not appear for him in the case Mr Park having cal[l]ed on me as his counsel from what I told Mr Fry.

     I regret that Mr Beverly did not inform you of the difficulty immediately when it occurred.

     I now will return you the check for the fee. The answers I have retained with a View of Sending them by the first opportunity to the Clerks office. presuming that they are not wanted for any other purpose than to be filed. I am Sir very respectfully ys
