Case agreed. “The plaintiffs being bona fide, and for a valuable consideration, possessed of certain notes issued by this Bank, and having occasion to remit money to Baltimore, cut them in halves, and in February 1806, enclosed'-the half parts of said notes to their correspondent in Baltimore, which were 

“The policy in question, was effected on the 27th of June, 1807, on goods, the property of the plaintiff, an American citizen, on board the Little William, belonging to Jacob Sperry, also an American citizen, at and from Philadelphia to Tonningen, or Hamburg, if not blockaded; warranted American property, proof whereof to be made here. She sailed on the voyage insured, on the 3d of July 1807.

“A verdict having been rendered in this case, at April Sessions, 1807, and a new trial awarded, the cause now came on again to be tried. The defendant being indebted to the plaintiff, in a certain sum of money, was, in September, 1804, discharged under the insolvent law of this State.
